ONLINE STORE – CONDITIONS OF USE

PARAGRAPH 1.
DEFINITIONS
Definitions used in these Conditions of Use shall have the following meaning:
BIOMOL-MED - Biomol-Med Sp. z o.o. with its registered office in Łódź, ul. Huta Jagodnica 41, registered in the Business Register kept bz the District Court for the city of Łódź-Śródmieście, 20th Department of the National Court Register under number 0000136366, NIP 727-25-73-736.
Store – an online store operated by Biomol-Med, with the address www.biomol.pl
CONDITIONS OF USE – these Conditions of Use regulate the scope and conditions of services rendered by Biomol-Med within the scope of Store.
SERVICE – a service offered for sale through the Store in line with these Conditions of Use.
USER – A Buyer registered in the database of Store users.
Buyer – a User, who places an order for the purchase of a selected Service.
SELLER – an operator of the Store (Biomol-Med Sp. z o.o.), which sells Services.
ARTICLE 2.
GENERAL TERMS OF SALE
2.1. Services are sold through the Store by concluding a purchase agreement online.
2.2. A purchase agreement is concluded, when a Buyer places an order, the processing of which is confirmed by the Seller.
2.3. Information on Services and contained on the Store’s websites do not constitute an offer within the meaning of the Civil Code.
2.4. Going prices of Services are on the Store’s websites – they are inclusive of VAT. Subject to point 2.6 below, the presented price of each Service is binding on placing an order by a Buyer.
2.5. The Seller reserves the right to amend the prices of Services on offer, introduce new Services to the Store’s offer, carry out and cancel promotional campaigns on the Store’s websites or to modify them.
2.6. If the price of a Service changes after the Buyer has placed an order, the Buyer may, upon obtaining this information, immediately, but not later than within 7 days, resign from the order through communication media indicated in article 8 point 8.8 of these Conditions of Use.
ARTICLE 3.
CLIENT REGISTRATION IN DATABASE
3.1. Users are registered in the Store database by completing registration form available from the Store’s website.
3.2. The User is obliged to update details contained in the registration form immediately after each change of these details.
3.3. During registration the User consents to storing and processing of their personal details by the Seller, on the conditions laid down in Privacy Protection Policy. All personal details submitted by the User shall be processed in accordance with the legislation in force.
ARTICLE 4.
PRIVACY PROTECTION POLICY
4.1. The Seller ensures the safety of the Users’ details.
4.2. Personal details of the Consumers are processed for the purpose of the processing of orders for Services, accounting and marketing, in pursuance of the Personal Data Protection Act of 29 August 1997.
4.3. The User may request to have their personal details removed from the database.
4.4. The Seller provides the complete protection of details submitted by the User from third party’s access and from their disclosure, to the extent, where in specific situations the disclosure of details may be required by law.
ARTICLE 5.
PLACING AN ORDER AND ACCEPTANCE OF ORDER FOR PROCESSING
5.1. Users may place an order after they log in to to a particular User account by entering their login and password.
5.2. By placing an order the Buyer accepts these Conditions of Use.
5.3. A placed order constitutes an offer within the meaning of the Civil Code. A confirmation of the acceptance of the order for processing by the Seller is an acceptance of the offer in accordance to the content of the Seller’s declaration.
5.4. Within 48 hours from the receipt of an order the Seller shall electronically confirm its acceptance for processing. This period may be extended, if it expires on a public holiday (Sundays and holidays). The order shall be then confirmed on the following working day. By confirming the acceptance of the order for processing, the Seller provides the Buyer with an order number and value, including transport costs.
5.5. The Seller reserves the right to refuse to accept an order for processing, if:
- Details submitted by the Buyer in the order form are incomplete or incorrect, and if the person that places an order has failed to follow these Conditions of Use;
- The Buyer has failed to pay for a Service in pursuance of these Conditions of Use.
ARTICLE 6.
ORDER PROCESSING
6.1. If the Seller confirms the acceptance of an order for execution under Article 5 of these Conditions of Use, and if the Buyer pays the price for a Service, the order shall be processed as follows:
6.1.1. In an Elemental Hair Analysis Kit is ordered: the analysis kit (an inquiry form, an information bulletin, a return envelope, a hair bag) will be sent the to the Buyer’s address. The Buyer shall prepare the kit for shipment as per the instruction included in the received Information Bulletin, then sends it to Biomol-Med. Biomol-Med has 3 weeks to send back an Elemental Hair Analysis to the Buyer counting from the date of the obtainment of the complete kit.
6.1.2. If an Additional description in a foreign language is ordered:
- If an order concerns an already performed analysis, Biomol-Med will send the result in a selected language version to the Buyer’s address within 72 hours from the obtainment of the payment for a Service.
- If an order concerns a new service, the Buyer will receive a Hair Analysis result in accordance with the procedure laid down in point 6.1.1 in an adequate number of descriptions languages selected in the order.
6.2. The above periods may be extended, if it expires on a public holiday (Sundays and holidays). The order shall be then confirmed on the following working day.
6.3. The payment for a Service includes its price and shipment cost in pursuance of these Conditions of Use.
6.4. The payment for an ordered Service may be only in the form of a prepayment by transfer to the indicated bank account of the Seller, or by payment card through the Store website while placing an order. The payment must be made within 7 days from the receipt of a confirmation of the acceptance of an order for processing.
6.5. Ordered Services are delivered to the address submitted by the Buyer, by a deliverer (Poczta Polska).
6.6. On the collection of the Service the Buyer is obliged to check, if the shipment has any damages sustained during transport, or if it is in line with an order.
ARTICLE 8.
COMPLAINTS
8.1. The Seller sell to the Buyer a Service specified by the Buyer in an order, according to the description of the Service available from the Store website.
8.3. Eventual complaints regarding the purchased Service may be submitted by the Buyer in writing to the address below in point__
8.5. Complaints should include an order number, the name of a Service, the scope of a complaint and other documents attesting the Buyer’s request.
8.7. Subject to the provisions laid down in point 8.6, complaints are considered within 14 days from the receipt thereof by the Seller. A reply to the complaint is sent in an electronic form to the Buyer’s address, which is submitted into the Users database or in writing to the correspondence address.

ARTICLE 9.
CHANGES IN THE CONDITIONS OF USE
9.1. The Seller reserves the right to amend the content of these Conditions of Use.
9.2. On logging in to the Store websites the User will be notified on this change; if the User does not accept a new content of the Conditions of Use the orders placed before the change in the Conditions of Use shall be processed in accordance with the former principles provided for by the Conditions of Use regarding order processing.
ARTICLE 10.
FINAL PROVISIONS
10.1. All matters not governed by these Conditions of Use shall be subject to relevant provisions of the laws of Poland.
